Our position on copyright

The Gist Post respects the intellectual property rights of others and expects the same of anyone whose work appears on this site. In accordance with the Digital Millennium Copyright Act ("DMCA"), we will respond to valid notices of claimed copyright infringement.

Filing a DMCA notice

If you believe your copyrighted work has been copied and is accessible on this website in a way that constitutes infringement, please send our designated agent a written notice that includes all of the following:

A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
Identification of the copyrighted work claimed to be infringed.
Identification of the material claimed to be infringing, with enough detail (such as the exact URL) for us to locate it.
Your contact information, including your address, telephone number, and email address.
A statement that you have a good-faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.
A statement, made under penalty of perjury, that the information in your notice is accurate and that you are authorized to act on behalf of the copyright owner.

Counter-notification

If material you posted was removed or disabled by mistake or misidentification, you may file a counter-notification with our designated agent. It must include:

Your physical or electronic signature.
Identification of the removed material and the location where it appeared before removal.
A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
Your name, address, and telephone number, and your consent to the jurisdiction of the federal district court for the judicial district in which your address is located.

Repeat infringers

We maintain a policy of removing content from contributors who are repeat infringers of copyright, and we reserve the right to terminate access for users who repeatedly infringe the rights of others.

Fair use

We believe in fair use and may reference copyrighted material for purposes such as criticism, comment, news reporting, teaching, scholarship, or research, always with attribution and within the bounds of fair-use principles.

Affiliate content

Some articles contain affiliate links, and product imagery or descriptions may be supplied by merchants or affiliate networks. We believe such usage falls within fair use; nevertheless, we will promptly remove or disable any content upon receiving a valid DMCA notice.

Response time

We aim to respond to valid notices within 24–48 hours. Upon receiving one, we will remove or disable access to the allegedly infringing material and notify the person who published it where applicable.
